01Preamble

These Terms of Use (hereinafter "Terms") govern access to and use of the website ethneia.com (hereinafter "the Site"), published by Alphamart Global LLC, operator of the ETHNEIA Cosmetics brand.

The Site is a showcase site presenting the ETHNEIA brand and its products. No sale is concluded directly on the Site. ETHNEIA products are marketed exclusively via the Amazon platform.

By browsing the Site, you (hereinafter "the User", "you") acknowledge that you have read these Terms and accept them without reservation.

03Nature and Purpose of the Site

The Site is a showcase website. Its purpose is to:

• present the ETHNEIA Cosmetics brand and its editorial universe;
• describe the range of hair treatments (Hydra Curl, Nutri Curl, Condi Curl);
• publish editorial content (Journal) for informational purposes;
• redirect Users to the Amazon platform, where the products are actually marketed.

No order, payment, reservation or contract-conclusion functionality is offered on the Site. Any commercial transaction relating to ETHNEIA products is carried out exclusively on Amazon and is subject to Amazon's general terms and conditions of sale and use.

04Acceptance of Terms

Use of the Site implies your full and unreserved acceptance of these Terms. If you do not agree with all or part of these provisions, we invite you not to use the Site.

The applicable Terms are those in force at the date of your visit. The publisher reserves the right to modify them at any time; modifications come into effect upon their publication on the Site.

05Use of the Site

The Site is intended for strictly personal and non-commercial use. You undertake to use it in compliance with applicable laws and these Terms, and in particular not to:

• reproduce, copy, sell or commercially exploit the Site's content without authorization;

• harm the image of the ETHNEIA brand, its reputation or that of third parties.

06Product presentation

The products presented on the Site are hair cosmetics manufactured in France, compliant with the applicable European regulation (EC Regulation No. 1223/2009 on cosmetic products).

Product photographs and descriptions are provided for illustrative purposes. Precise characteristics (composition, format, usage advice, precautions) are indicated on the Amazon product page and on the product packaging itself. Minor variations in shade, texture or presentation may exist from one batch to another without constituting a non-conformity.

07Sales via Amazon

ETHNEIA products are marketed exclusively via the Amazon platform. When you click on a "Discover on Amazon" button or equivalent, you leave the Site and are redirected to the Amazon platform.

From this redirection onwards, Amazon's general terms of sale and use apply. Alphamart Global LLC, operator of the ETHNEIA brand, acts on Amazon as a seller listed on the platform, but is not a party to any contract concluded on the Site itself — no sales contract being possible on the Site.

For any question regarding an order, delivery, payment, return or withdrawal made via Amazon, please refer to Amazon's customer service and to Amazon's terms, which notably include the A-to-Z Guarantee and dedicated recourse procedures.

08Indicative prices

The prices displayed on the Site are provided for strictly indicative purposes, in euros, all taxes included. They correspond to the price observed on Amazon as of the Site's update date and may vary according to promotional periods, stock levels and Amazon's pricing policies.

The actually applicable price is the one appearing on the Amazon product page at the time of purchase. Delivery fees, if any, are specified on Amazon before order validation.

09Liability

The publisher makes every effort to ensure the accuracy of the information published on the Site. However, its liability cannot be engaged in the event of errors or omissions, temporary unavailability of the Site, or indirect damages resulting from its consultation.

Cosmetic products must be used in accordance with the instructions on their packaging. The publisher cannot be held liable for improper use, application not in accordance with the precautions, or an individual allergy to an ingredient otherwise authorized by European regulation.

In case of doubt, and particularly in case of an allergic history, it is recommended to carry out a preliminary test on a small area of skin and to consult a healthcare professional.

10Intellectual property

The entirety of the Site's elements — the ETHNEIA brand, the logo, the graphic charter, texts, photographs, videos, formulations, product names — is protected by intellectual property law and remains the exclusive property of Alphamart Global LLC or its rights-holders.

The ETHNEIA brand is a trademark registered with the French National Institute of Industrial Property (INPI) under number 5151991.

Any reproduction, distribution, adaptation or exploitation, in whole or in part, without prior written authorization, is strictly prohibited and would constitute infringement subject to sanction under articles L.335-2 et seq. of the French Intellectual Property Code.

11Personal data

The processing of your personal data is described in detail in our Privacy Policy, which is an integral part of these Terms.

12Applicable law & jurisdiction

These Terms are governed by French law.

In the event of a dispute relating to the use of the Site, you are invited to contact us first at info@ethneia.fr in order to seek an amicable solution.

Failing an amicable resolution, the French courts shall have sole jurisdiction, subject to mandatory jurisdictional rules applicable to consumers.

Disputes relating to sales made on Amazon fall exclusively under Amazon's general terms and its internal resolution procedures (A-to-Z Guarantee, mediation, recourse channels provided by the platform).

Note to international visitors: ETHNEIA Cosmetics is a brand operated by Alphamart Global LLC and distributed in France. Local consumer protection laws of your country of residence may provide additional rights that cannot be waived by these Terms.

13Modifications

The publisher reserves the right to modify these Terms at any time, particularly to reflect changes in its activity, regulations or jurisprudence. The applicable version is the one in force at the date of your visit.

If direct sales were to open from the Site in the future, these Terms would be replaced or supplemented by specific Terms and Conditions of Sale, of which you would be informed before any order.
